Mr. Muchnick advises companies concerning a myriad of day-to-day employment-related issues, including litigation avoidance strategy relating to terminations and other employment actions, disability and leave issues, wage and hour compliance practices, workplace investigations, post-employment activities of departed employees, minimizing risks associated with hiring individuals from competitors, demands by current and former employees, and personnel policies and procedures.  Mr. Muchnick also advises clients regarding a broad range of general business and contractual matters.

Clients rely on ​Mr. Muchnick to prepare, provide advice regarding, and negotiate executive employment agreements, restrictive covenant agreements, separation agreements, transition agreements, independent contractor agreements, and sales representative agreements.  Mr. Muchnick also develops commission, bonus, compensation, and other incentive plans, employee handbooks, and personnel policies, all of which are tailored to each client’s business.


Mr. Muchnick’s experience representing companies also includes conducting executive-level and other training concerning a variety of employment law topics.


Mr. Muchnick also advises businesses on the labor and employment aspects of business transactions, including mergers and acquisitions.  Mr. Muchnick oversees due diligence of a target’s employment practices, negotiates employment-related provisions in transaction documents, counsels clients on executive employment agreements and arrangements, and provides post-closing legal counsel and services.


​In addition to his counseling practice, Mr. Muchnick has extensive litigation experience.  Mr. Muchnick’s litigation experience includes defending companies against claims: arising under federal and state anti-discrimination laws; for breach of executive employment agreements and equity agreements; for wrongful discharge in violation of public policy; under the Family and Medical Leave Act; under the Whistleblowers’ Protection Act; for retaliation under the Occupational Safety and Health Act and the Michigan Occupational Safety and Health Act; under Michigan’s Sales Representative Commission Act for unpaid commissions, enhanced damages, and attorneys’ fees; challenging independent contractor classifications; and under the National Labor Relations Act.


​Mr. Muchnick’s litigation experience further includes prosecuting and defending cases filed in states around the country involving claims for breach of non-competition agreements, breach of non-solicitation agreements, breach of fiduciary duties, employee raiding, misappropriation of trade secrets, unfair competition, and tortious interference with business relationship and business expectancies. 


Mr. Muchnick’s experience also includes representing companies in the defense of collective actions under the Fair Labor Standards Act and class actions under state laws involving various wage and hour issues, including unpaid overtime compensation, unpaid minimum wage, and challenging the exempt classification of large groups of employees.
